General terms and conditions
To all deliveries oforders made by phone,email and/or through the website of Wheelylift the following conditions apply.

Article 1. General
Wheelylift.com(www.wheelylift.com) is a webstore of Malton Storage B.V..These terms and conditions apply to the preparation, the content and fulfillment of all agreements between you, the buyer and us, Wheelylift. General (purchasing) conditions of the purchaser do not apply to these agreements unless explicitly agreed otherwise in writing.

Article 2. Definitions
In these terms we mean by you (the buyer): the natural orlegal person who to us (Wheelylift) has ordered the delivery of products and/or performing work.

Article 3. Cooling off period
If you buy from a shop on the Internet, you have the right to a "reflection period" of 7 days, during which you can cancel the purchase. This is regulated by law and mandatory for us to mention in our conditions. Provided applicable, you should yourself ensure the return of the product. Returns are only accepted if the product is unused, complete, in original, sealed packaging, undamaged and sufficiently stamped. The costs for returns are at your expense.

Artikcle 4. Price/Shippingcost
The prices of all products that can be ordered through the Internet site are including VAT.
The prices of goods listed on the website, are subject to change for any reason whatsoever.
For shipping (both inside and outside the Netherlands) of the products ordered the services of an external carrier will be used. These shippingcosts will be made known to you on ordering and will be charged to you.

Article 5. Delivery
The specified deliverytimes are indicative. Delayed delivery does not entitle you to compensation. We deliver throughout Europe.
The delivery of the products is made at the time and place at which the products are ready for shipment to the buyer.
Subject to the foregoing in Article 5 of these terms and conditions, we deliver accepted orders expeditiously but at least within 30 days. If the delivery either by (temporarily) out of stock, or for other reasons, is delayed, or if an order is not or only partially carried out, you will receive notice the latest one month after you have placed the order. In that case you have the right to cancel the order without any charge. We reserve the right at all times to refuse orders without motivating reasons.
If your ordered items are in stock you can expect a delivery time of 3 days (in the Netherlands, abroad is longer) after the payment of the ordered products is received.
In the case items which are ordered are not in stock and must be ordered, the estimated delivery time will be communicated to you as soon as possible. If the expected delivery time is over a month, you are entitled to cancel the order.
We send the ordered products through a mail or package service. If an order cannot be delivered because nobody is home, the delivery will be offered 2 times more at a different time/different date. If after that the order still can’t be delivered, it will be stored with the carrier until a new order for delivery comes in. In a second round delivery additional costs might be charged. These costs are for your expense.

Article 6. Complaints and liability
You have the obligation to examine at delivery whether the products meet the agreement. If this is not the case, you must inform us within seven (7) working days in writing or by e-mail. After the expiration of this period you will be deemed to have accepted the goods.
If  demonstrated that the products do not meet the agreement, we have the choice to replace the products by new products, or to refund the invoice value.
If, for whatever reason, you do not wish to keep the purchased product, you have the right to return the product within seven (7) days after delivery. Returns are only accepted if the product is unused, complete, in original, sealed packaging, undamaged and sufficiently stamped. The costs for returns are at your expense.
Within 7 days after receipt by us and after inspection of the product we refund the money back.
If you want to exchange the purchased product for another product or model you first need to resend the purchased product complete, in original packaging, undamaged and sufficiently stamped within seven (7) working days at you own expense. We will then send you a new product or type without additional costs.Any difference in price will be paid extra by you or will be refunded by us.
Unexpected price increases by the manufacturer and typing errors in prices and or text are reserved. From this visitors of the website or buyers cannot derive any rights.

Article 7. Warranty
Your order is taken care of with the utmost care, but should there be any unexpected problems with your order, the following provisions apply:
- Returning of the product is only possible if your product shows material errors on delivery. You need to infomr us in writing by return.
- Wear and use errors/tracks can never fall under warranty.
- Complaints that are mentioned to us within 7 days after delivery will no longer be accepted.
- Wheelylift: Warranty only apllies to the product of the Wheelylift itselfs (1 year). There is no guarantee on mounting structure etc. 

Article 8. Payment
Unless otherwise agreed, the price and other amounts due under the contract have to be paid before delivery, without the possibility of claiming any discount, deduction or suspension.

Article 9. Communications
For wrong or delayed shipments of order data and communications as a result of using the Internet or other communication between you and us or between us and third parties, as far as they relate to the relationship between you and us, we are not liable.

Article 10. Liability
10.1 In the event the Buyer sustains damage as a result of a faulty product supplied by Wheelylift, the total liability of Wheelylift shall be limited to the amount paid in such case under the product liability insurance or insurances held by Wheelylift. If, for whatever reason, no insurance pay-out is made, the liability of Wheelylift shall be limited to the amount of the invoice for the faulty product that caused the damage. The above is subject to the proviso that Wheelylift is not liable for any damage that results from incorrect use of its products that is not consistent with the requirements and/or user instructions provided by Wheelylift.
10.2 In addition to the provisions of Article 9.1, Wheelylift is only obliged to pay compensation for damage on the basis of any contractual and/or non-contractual liability, if and insofar as this damage is the direct result of gross negligence by Wheelylift or its management.
10.3 The Buyer indemnifies Wheelylift against all damages and claims by third parties that are related, either directly or indirectly, to the execution of the Agreement.
10.4 The Buyer is required to take all reasonable measures to prevent or limit the damage referred to in this Article.
10.5 The limitations of liability referred to in this Article do not prejudice mandatory liability or mandatory rights of recourse in connection with claims.

Article 11. Applicable law
On agreements between you and us only Dutch law applies. All disputes between parties will be brought before the competent court in the Netherlands.
